Access Denial Process for Inappropriate or Obscene Content

Some content shared online can seriously violate not only personal rights, but also public morality, public order and children’s rights. In particular, the rapid spread of content such as obscene content, child abuse, incitement to prostitution or pornographic websites is a major threat.
You have the right to request a direct access block against such content through the ICTA. In this content, we discuss in detail the processes carried out both through the ICTA and by court order.
Legal Basis: Law No. 5651 – Article 8
Article 8 of Law No. 5651 The access blocking order can be issued directly by the ICTA (Information and Communication Technologies Authority) for content that contains the following catalog crimes:
- Obscenity (pornographic content, child pornography)
- Promoting and facilitating prostitution
- Enabling gambling
- Encouraging the use of drugs or stimulants
- Terror propaganda
- Insulting Atatürk

Access Barrier Application Procedures
1. Direct Application to ICTA (Administrative Route)
If the content is within the scope of a catalog crime, an application can be made to the BTK via e-Governmentwithout waiting for a court decision:

Required information:
- Link to the infringing page (URL)
- Screenshot if available
- Short description
- Contact details of the complainant
Application to the 2nd Criminal Judgeship of Peace
- If BTK does not take swift action or if the content does not cover a catalog crime
- In cases such as the right to privacy and the open display of the face
- An application is made to the Criminal Judge of Peace and an access blocking order can be requested for the content.

Foreign Sourced Content
Although foreign obscene content cannot be deleted directly, access can be blocked from Turkey. The decision is implemented by the ICTA.
